Labor Petitions – H-2A Visa
The H-2A Program allows U.S. employers or agents who meet specific regulatory requirements to bring foreign nationals to the United States for the purpose of filling temporary jobs in agriculture.
The employer must submit the forms and documentation necessary for this process .
To qualify for the H-2A Nonimmigrant classification, the petitioner must:
- Offer a job of a temporary or seasonal nature.
- Demonstrate that there are not enough capable, willing, qualified, and available American workers to perform temporary work.
- Demonstrate that hiring H-2A jobs will not affect the wages and working conditions of U.S. employees in similar tasks.
- Present a valid Temporary Labor Certification issued by the United States Department of Labor.
